Exiled novelist Kakwenza Rukirabashaija has petitioned the Uganda Human Rights Commission (UHRC) accusing the passport office of violating the rights of his children to own a passport. 

In his June 20, 2022 petition filed by counsel Eron Kiiza, Kakwenza says that his three children namely Rutakirwa Mugabe Kakwenza aged 2 years, Siima Nyinaboona Kakwenza, 4, and Nina Kayitesti Kakwenza, 9, applied for express passports, submitted all the relevant documents and attended the mandatory interviews in March 2022.

"Despite the children, their parents, and their lawyers religiously following up the citizens' application for passports since March, the Directorate of Citizenship and Immigration Control has refused to grant the children of Kakwenza Rukirabashaija their passports contrary to article 29 (2) of the Constitution the Republic of Uganda and Section 39 of the Uganda Citizenship and Immigration Control Act, Cap 66 which guarantees the right to every Ugandan citizen to a passport," reads the letter.

He explains that no reason has been given to date for the delay in granting the passports to the said children yet other Ugandan citizens continue getting their passports. Express passports are usually issued within a week, depending on the number of applicants. 

"This is to draw your attention to the human rights violations and injustice against the children and seek your immediate intervention to enable them to receive their passports and further their dreams without being marginalized" the letter further reads.

However, Simon Mundeyi, the Internal Affairs ministry spokesperson, says that he is not aware of any application by Kakwenza's children and that if indeed they applied, they should avail all their application details to the Immigration Control office for follow-up.

"There is no way we can work on an application we don't have. Whatever Kakwenza did, doesn't affect the children, they are innocent. Even Kakwenza himself has a passport. If one is a Ugandan and hence qualifies for a passport, there is no way they can be denied one," said Mundeyi. 

Kakwenza, who is currently in Germany was arrested on December 28, 2021, for allegedly abusing the first son, Lt. Gen. Muhoozi Kainerugaba, and his father, President, Yoweri Kaguta Museveni through his social media posts. He was reportedly tortured under the supervision of Muhoozi. He fled the country after being released on bail, saying he needed urgent treatment, which he couldn't access in Uganda.

Ever since he left, Kakwenza has filed several petitions including one before the East African Court of Justice alleging human rights violations and the Judicial Service Commission where he accused Dr Douglas Singiza, now an acting High court judge of exhibiting a level of unprofessionalism while handling his case in Buganda Road Chief Magistrate's court.

These Tutsis also with fighting to be relevant...apparently Kakwenza is a kinyarwanda name. Why don't you go back to Rwanda or Burundi?

After all, that is where you first fled to from Uganda - obviously through "home". And that brings back bad memories for us Baganda - because when Mutesa fled in 1966, he went via Rwanda and Burundi through to the UK....and probably established some contacts there - which the current Kabaka used years later and see what they produced....Prince Junju with a powerful tutsi mother Venetia Sebudandi. The only way you can save your children, all children is by;

*Calling for an end to the tribalistic system & to UNITY of Ugandans that will bring an end to Museveni's evil hold on Uganda!

Uganda belongs to Museveni & those in posts, including the responsible at Passport office, are Ugandans & they work to ensure their posts/safety with Museveni!

Once Ugandans are ONE PEOPLE, will Museveni still be in State House & will those in posts still work for him torturing Ugandans?

The fight against Museveni can only be when Ugandans bring down the tribalistic system/wall Museveni built to ensure our people are POWERLESS & all work for him!

Why is it Ugandans & families forced out of Uganda & not migrant Museveni & family?

Kakwenza hasn’t mentioned in his petition that the passport office’s failure to give his children passports has anything to do with him as an individual. However, the spokesperson of the Internal Affairs Ministry has intimated that the children cannot be refused passports because of Kankweza’s actions as they are innocent.

Firstly, the spokesperson appears to imply that Kankwenza is guilty of a crime although he has not been convicted by a court of law. Secondly, unless Kankweza’s actions have a bearing on the decision not to issue the passports promptly, why allude to it when the the petitioner, Kankweza, hasn’t raised it as a reason for the delay?

Guilty conscience needs no accuser! Furthermore, unless Kankweza needs to be institutionalised, why would he petition UHRC if the applications haven’t even been made? This is a manifestation of the arrogance of this regime as they no longer care about how it is perceived.

Since you say government is denying them the same let them travel the same way you did. That is travel without a Ugandan passport

Mukasa, right on the money. You nailed it on the head. Mundeyi gave so many answers which gave him away as an accomplish to the abuse of Kakwenza's kids' right He says he [as an individual] is not aware of the applications!

However, he is the spokesman of the ministry of internal affairs to which the applications were made. Therefore it he wasn't aware as an individual, then he would have said that he would find out about the matter and make an informed response.

However, he went ahead of informing us the obvious, mbu the kids are innocent and entitled to get passports, mbu because even Kakwenza also got one! What a Schaumburg!

Sekabala my dear, Kakwenza may well be a mu Nyarwanda, but he immigrated to Uganda and became a citizen.

Our goal ought to be able to establish laws that could be respected. M7 is believed to a Munyarwanda and born in Rwanda. But he is the president of Uganda, simply because he, together with other banyarwanda, Kagame, Rwregyema, and others, used violence and the gun to capture power! Now, unfortunately, we are surrounded by Banyarwa allover! Kakwenza is one of those fighting for democracy and rule of law in Uganda. Until we establish immigration laws which are clear, we are in deep shit! M7 has given immigrants from allover more rights than indignant citizens! Indians, Chinese, Sudanese, Somalians, you name it! Why? Because they don't have Uganda at heart to fight for our freedom.

Ssekabaka you have a Ganda point. One hopes you are intitled to your opinion.

There are many more Ganda fraternity that will scream their heads off for what you are saying. However it was Kabaka Mutebi's daddy who would have wished for an East African Passport if Kenya and Tanganyika were not British African colonial countries.

He was even exiled because of all that business. One hopes that Kabaka Mutebi and his family was one of the first to accept the current East African passports against the Uganda passports. Certainly so. Kenya, Tanganyika, Zanzibar, Uganda, Buganda, Rwanda, and so on are presently independent countries.

Buganda......does it still exist? I know historically there was a region called Buganda. Today, every other person in Kampala claims to be a Muganda.

When you dig further, you find that they are not. Secondly, does it really matter ....Buganda and being a Muganda? Do you get a monthly cheque to help with your bills from the Sabasajja or do you struggle like the rest of us? Buganda, Baganda, Rwanda, Ttusi ....Basoga, Luo, we are one people! I argue with fellow Ugandans to discuss matters of substance like why are still poor when god gifted us with so many resources? How do we get out of this situation?
